Mr. Fucillo has more than 30 years of broad-based environmental, land use and litigation experience, as a Judge Advocate, as an environmental regulator, and in private practice.  He advises clients with respect to a full range of environmental regulatory and enforcement and land use issues and litigates disputes in state and federal courts and before administrative agencies.  Mr. Fucillo’s environmental and land use practice includes counseling, litigation and negotiation concerning: the State Environmental Quality Review Act (“SEQRA”); CERCLA; New York’s Navigation Law governing petroleum spills; gas leasing and Hydro-Fracking; toxic torts; wind power, cellular facilities and environmental permitting; as well as many other substantive areas of environmental law.  He has been Special Counsel to several municipalities and represents developers, municipalities and private litigants with respect to SEQRA compliance, “right to build” and other land use issues.  

 

Prior to joining the firm, Mr. Fucillo was Regional Attorney in Region 7 of the New York State Department of Environmental Conservation, responsible for environmental enforcement and legal affairs in the nine county Region in Central New York.  Prior to that, he was the Assistant Regional Attorney in NYSDEC’s Region 6.  He began his legal career as a Judge Advocate in the U.S. Navy JAG Corps, as successful prosecutor and defense counsel while on active duty at Naval Air Station, Brunswick, Maine. 

 

Mr. Fucillo has been named to The Best Lawyers in America since 2009, and to Super Lawyers since 2013.  He was recently named Best Lawyers' 2018 Syracuse Litigation - Environmental "Lawyer of the Year".  Only a single lawyer in each practice area in each community is honored as "Lawyer of the Year".  

 

He has co-authored an article in the Matthew Bender publication, Environmental Law in New York, entitled, “Petroleum Discharges and the New York State Navigation Law”, and has lectured at various New York State Bar Association and other private Continuing Legal Education programs.
